LAWS AND RIGHTS

Understand the ADA before taking action

Accurate information protects handlers, animals, businesses, and communities. This guide summarizes general principles and links to official sources.

01

Federal definition

ADA Titles II and III primarily recognize dogs individually trained to perform tasks related to a disability. Separate provisions address miniature horses.

02

What a business may ask

If the function is not obvious, staff may ask whether the animal is required because of a disability and what task it has been trained to perform.

  • Staff may not demand documentation.
  • Staff may not ask for a diagnosis.
  • Staff may not require a task demonstration.
03

Control and behavior

The animal must be under control. It may be removed if it is out of control and the handler does not take effective action, or if it is not housebroken.

04

State and local laws

Some states provide additional protection or penalties for falsely representing a pet as a service animal. Always consult official sources for your jurisdiction.
